1. The HHN service

HHN provides a technology platform for industry participants to create profiles, find people and work, post opportunities, express interest, record verified working relationships, submit reviews and use verification/dispute features. Unless HHN expressly agrees otherwise in writing, HHN is not a party to contracts between members and is not the employer, principal contractor, subcontractor, labour-hire provider, insurer, licensing authority, payment guarantor or project supervisor for work arranged through the platform.

2. Member responsibility

Members are responsible for assessing whether another member, job or opportunity is suitable; conducting their own due diligence; confirming licences, insurance, qualifications, scope, price, payment terms, site conditions and legal obligations; and entering appropriate written contracts. Members must not rely solely on a profile, score, badge, review or verification status when making a commercial or safety decision.

3. Accounts and accuracy

You must be at least 18 years old and legally capable of entering a contract to create an HHN account. If you use HHN for a company, partnership, trust or other organisation, you must have authority to act for that organisation.

You must provide information that is accurate, current and not misleading, protect your login credentials, and promptly update material changes. You must not impersonate another person or business, create deceptive accounts or manipulate platform reputation systems.

4. Jobs and member arrangements

Job posts are supplied by members. HHN does not promise that a listing is accurate, available, profitable, safe or suitable, or that a member will respond. Members negotiate and contract directly with each other. Unless HHN expressly introduces a separate payment product, HHN does not hold or guarantee payment for member-to-member work.

5. Reviews and verified relationships

Reviews must relate to genuine working relationships and reflect honestly held experience. HHN may require evidence, restrict reviews to verified relationships, moderate content, investigate manipulation and remove or restrict content where reasonably necessary for platform integrity, legal compliance or safety. A review or Hard Hat Score is opinion/reputation information, not a warranty by HHN.

6. Verification badges and public registers

For ABN and contractor/trade-licence badges, HHN may compare member-supplied details against public government registers. A badge records a point-in-time match/check only. It does not mean HHN issued the ABN or licence, and it does not guarantee continuing validity, future conduct, workmanship, financial capacity, insurance response, regulatory compliance or suitability for a particular job. Users should re-check material information with the relevant authority where appropriate.

7. Insurance and licensing

Members remain solely responsible for holding all licences, registrations, insurance and approvals legally required for their activities. HHN does not require a driver licence or passport merely to check an ABN or contractor/trade licence against a public register. An uploaded Certificate of Currency does not mean an insurer has confirmed coverage for a particular claim, activity, site or contract. Users should independently confirm material cover where appropriate.

8. Disputes

HHN may provide tools to exchange information and record the status of disputes. Unless expressly stated otherwise, HHN does not act as a court, tribunal, regulator, arbitrator or legal adviser and does not guarantee resolution. HHN may take reasonable platform action independently of the legal merits of the underlying commercial dispute to protect platform integrity or users.

9. Prohibited conduct

You must not use HHN unlawfully; harass, threaten or defame others; publish knowingly false information; manipulate ratings or relationships; scrape or misuse member data; upload malware; attempt unauthorised access; infringe intellectual property; or use verification documents for an unauthorised purpose.

10. Suspension and termination

HHN may restrict, suspend or terminate access where reasonably necessary for suspected fraud, safety, security, repeated complaints, unlawful conduct, material breach, protection of another user or the platform, or compliance with law. Where appropriate, HHN may request information before deciding what action to take.

11. Free membership and optional paid products

Core HHN membership is currently free and does not require a recurring membership subscription. HHN may separately offer optional paid products such as featured profiles, job promotion, advertising, sponsorships or partner services. Any optional paid product will be described and priced before purchase, including any applicable billing or cancellation terms. Paying for promotion does not buy, alter or guarantee a Hard Hat Score, review, verification badge or reputation outcome. Nothing in these terms excludes rights or remedies that cannot lawfully be excluded.

12. Intellectual property

HHN owns or licenses the platform, branding and underlying software/content excluding member content. Members retain rights in content they submit but grant HHN a non-exclusive licence to host, reproduce, format and display that content as reasonably required to operate and promote the service, subject to privacy settings and law.

13. Availability and third parties

The service may experience outages, maintenance, data-provider changes or third-party failures. HHN may link to or rely on third-party services and public registers but does not control them or endorse third parties merely by displaying information sourced from them.

14. Liability

To the maximum extent permitted by law, HHN is not responsible for loss caused by a member’s work, non-payment, project delay, injury, defective work, inaccurate member information, third-party conduct, or a decision to engage or not engage another member. Where a guarantee, condition or remedy cannot legally be excluded, these terms do not exclude it. Any limitation applies only to the extent permitted by applicable law.

15. Indemnity

To the extent permitted by law, you are responsible for losses reasonably suffered by HHN arising from your unlawful conduct, material breach of these terms, infringement of another person’s rights, or content you submit, except to the extent the loss was caused by HHN’s own wrongful conduct.

16. Governing law

These terms are governed by the laws of New South Wales, Australia, subject to any mandatory law that applies otherwise. Courts and tribunals with jurisdiction under applicable law may hear disputes.
